Terms of purchase


1. GENERAL
1.1. The following terms apply between the Parties to purchases made on the Website.

1.2. The following definitions apply for interpretation of these terms:
”Less Worries” Less Worries AB, company reg. No. 559347-6343
”Customer” Anyone who orders products from the Website.
”Parties” Less Worries and the Customer.
”Order” Every order made by a Customer on the Website.
”Website” Less Worries’ website https://lessworries.com/.

1.3 Less Worries reserves the right to make changes to these terms on an ongoing basis. For any Order, the version of the terms that was valid when the Order was placed shall be applied.


2. CONFIRMATION OF TERMS

2.1. In order to be able to purchase products on the Website, the Customer must confirm their consent to these terms.

2.2. Consent to the terms is given by clicking on “Confirm” in the last step when ordering.

2.3. By confirming the terms, the Customer enters into an agreement with Less Worries and is obliged to pay for the products in the shopping cart.

2.4. In addition to these terms, the Parties are bound by Less Worries’ Personal Data Policy found on the Website.


ORDER

3.1. All purchases on the Website constitute Orders and are only accepted in accordance with these terms.

3.2. The Customer places an Order by adding the desired products to the shopping cart and then clicking to select payment method. The Customer then fills out personal and address information to be able to choose shipping method. The Order is completed when the Customer has clicked on “Complete purchase”.

3.3. When the Order has been completed, the Customer receives an order confirmation via e-mail, which contains essential information about the product/products, price(s), delivery date, payment terms, information about right to return/cancel and warranty.


DELIVERY

4.1. The normal delivery time is stated for each specific product on the Website, unless otherwise stated in the order confirmation or other agreement between the Parties.


4.2. Less Worries reserves the right to announce an adjustment of the delivery time if necessary.


4.3. Shipments are sent to the Customer with traceable delivery.


4.4. If a delivery is returned as a result of the Customer not picking it up, the Customer will subsequently be charged SEK 300 via invoice.


4.5. Less Worries shall be deemed to be delayed in delivery if the products are not delivered at all or are not delivered on time due to circumstances which are not due to the Customer and which do not constitute force majeure.


4.6. The Customer has the right to withhold payment for delayed products in the event of a delay and demand that Less Worries complete the Order. If the delay is significant, the Customer may choose to cancel the Order instead.


RESPONSIBILITY FOR DEFECTIVE PRODUCTS

5.1. A product shall be considered defective if it deviates from what is stated in the Order or from what the Customer could reasonably expect with regard to information provided by Less Worries. A product will also be considered defective if it is not suitable for the purposes for which products of the same type are commonly used.


5.2. A product shall be deemed to be defective if Less Worries has failed to inform the Customer of such conditions concerning the product’s characteristics that Less Worries knew or should have known and about which the Customer could reasonably expect to be informed.


5.3. In the event of a defective product, the Customer is entitled to repair, re-delivery, price reduction or compensation to rectify the defect. The Customer also has the right to withhold payment or, if the defect is significant, cancel the purchase.


In the event of claims made by the Customer, Less Worries has the right to primarily repair or re-deliver the product, if this can be done within a reasonable time, at no cost to the Customer.


5.4. Less Worries is only responsible for defects that were present at delivery. Defects discovered within two years are considered to have existed upon delivery, unless Less Worries can prove otherwise. After this period, the Customer must prove that the product was defective already upon delivery.


COMPLAINTS AND RETURNS

6.1. In order to claim a defect in a product, the Customer must complain about the product within a reasonable time after the defect was discovered. If the complaint is made within two months of the defect was discovered, the complaint is considered to have been made within a reasonable time. The Customer loses the right to claim defects in a product three years after delivery of the product.


6.2. Complaints are made by the Customer notifying Less Worries, verbally or in writing, of why they consider the product/products to be defective.


6.3. Less Worries is responsible for the cost of the complaint, provided that the product/products are defective.


6.4. In the event that Less Worries does not repair or re-deliver a product for which a complaint has correctly been made within a reasonable time, the Customer has the right to cancel the purchase or demand a price reduction.


RIGHT OF WITHDRAWAL AND CANCELLATION

7.1. The Customer always has the right to return their Order, in full or in part, within 14 days of delivery, in accordance with EU consumer law (right of withdrawal).


7.2. The Customer has the right to open the package during the first 14 days after delivery, and examine the product to the extent required to find out its essential properties.


7.3. In addition, Less Worries offers an additional 16 days (a total of 30 days) to freely return products, provided that the products are completely unused and in their original packaging (right to return).


7.4. When exercising the right of withdrawal or right to return, the Customer must return the product/products to Less Worries at their own expense.


7.5. The return must be submitted for shipping to Less Worries no later than 14 days after the Customer has notified Less Worries of the return, regardless of whether it is an exercise of the right of withdrawal or right to return.


7.6. Exercise of the right of withdrawal or right to return for an exchange of product or size is done by the Customer returning the product and making a new Order via the Website.


PRICES

8.1. The order confirmation must specify the price of the Products contained in the Order.


8.2. Prices are stated in Swedish kronor (SEK).


8.3. Prices include the VAT rate that applies at the time of the Order.


8.4. For deliveries outside Sweden but within the EU, any taxes are included in the price.


8.5. Any customs fees for delivery outside the EU are not included in the price and must be paid by the Customer to the relevant customs authority.


8.6.The prices stated on the Website and in the order confirmation may be subject to changes due to increased supplier costs, printing errors, other incorrectly stated specifications, and sales.


8.7. For the products that are marketed with a reduced price, Less Worries must ensure that the previous price is stated.


8.8. Discount codes cannot be used retroactively on an Order already placed.


8.9. Multiple discount codes cannot be used on one and the same Order.


PAYMENT

9.1. The Customer must pay for the Order no later than the time specified in the order confirmation.


9.2. Payment can be made by credit card, Swish, invoice, installment payment or account via Klarna Global.


9.3. When paying by invoice, Klarna AB is the payee and handles the payment.
9.4. Invoice payment must be made by the Customer no later than 30 days from the invoice date.


9.5. If the Customer is late with the payment, default interest will be added according to the Interest Act’s reference interest rate plus eight percentage points.


9.6. Ordered products belong to Less Worries until full payment has been made.


FORCE MAJEURE

10.1. In the event that Less Worries fails to fulfill its obligations due to circumstances that prevent, delay or impede the fulfillment of an obligation under this condition and which Less Worries has not reasonably been able to anticipate or control, Less Worries shall be released from liability to fulfill these obligations. Such circumstances may be, for example, failure of the authorities, changes in legislation, labor disputes, blockades or embargoes, fire, natural disasters, serious accidents or lack of means of transport, goods, raw materials or energy. This also includes delays from subcontractors due to such circumstances.


10.2. To be released from liability, Less Worries must notify the Customer of the grounds for force majeure without undue delay.


10.3. If the fulfillment of a material obligation under this condition is delayed by more than three months due to force majeure, the Customer has the right to cancel their Order with immediate effect, without this restricting their rights under this condition.


CUSTOMER INFORMATION
11.1. The Customer’s username is considered to be confidential information.


11.2. The Customer is responsible for keeping their confidential information secure from someone else’s access.


11.3. The Customer is responsible for ensuring that information provided to Less Worries is correct and current. If necessary, the Customer is responsible for updating this information.


11.4. If it is suspected that an unauthorized person has gained access to the Customer’s confidential information, the Customer must immediately report this to Less Worries and change their information.

12.2. All contacts with the Customer take place via the information the Customer last provided to Less Worries via the Website.

APPLICABLE LAW AND DISPUTE RESOLUTION

13.1. Swedish law shall be applied in the interpretation of, and any dispute arising in connection with these terms, without regard to other conflict-of-law rules.


13.2. Any disputes by reason of these terms are decided by a Swedish general court or court in the country where the Customer permanently resides.


13.3. The Customer always has the right to turn to the National Board for Consumer Complaints (Allmänna Reklamationsnämnden, ARN). If a dispute has been tried by ARN, Less Worries will follow ARN’s recommendation.
